נרשמו מספר הישגים בישיבה השנייה של ועדת הכלכלה הדנה בעניין האכיפה המנהלית של הרשות להגבלים עסקיים

בהמשך לנייר העמדה של הפורום להצעת החוק לאכיפה מנהלית ברשות ההגבלים העסקיים, שהוכן לקראת הדיונים בועדת הכלכלה, בהצעת החוק הנ"ל, להלן העדכון מישיבת הועדה השניה, שהתקיימה אתמול:

להלן הצלחותינו בדיון השני:

 

1. הוכנסה אבחנה בין התאגיד לבין היחיד.

2. התקרה על גובה העיצום על התאגיד הורדה מ- 30 מיליון ₪ ל- 24 מיליון ₪ ומ- 10% על המחזור ל- 8%.

3. לגבי היחיד, הוכנס הקריטריון של התחשבות בגובה הכנסתו השנתית מהתאגיד.

4. הוכנסו קריטריונים למדרג החומרה של העבירה.

 

 

זאת בנוסף להצלחותינו בדיון על הסעיף הראשון שהתנהל בסוף ינואר:

1.  סוכם שתהיה הפרדה בין אדם לתאגיד, לרבות בגובה העיצומים.

2.  סוכם שעל הממונה יהיה להיוועץ בוועדה לפני הטלת העיצום ואם תהיה התנגדות גורפת לממונה, הפרוטוקול של הדיון יוכל לשמש כבסיס לערעור על הטלת העיצום. הפרוטוקול יהיה כולל ומלא.

3.  הממונה צריך לציין מראש, ובחקיקה ראשית, מהם השיקולים שיעמדו לנגד עיניו לצורך הטלת עיצומים.
